Terms of Service
Daedalus5 sells two products, D5 Growth and D5 Echo, and these terms cover both. Where a section applies to only one of them it says so. If you bought a D5 Signal campaign before 5 September 2026, the terms you agreed to at the time still apply to it, and we will supply a copy on request.
Both products carry a written guarantee, and section 7 sets out those guarantees, their conditions and their limits in full. Every guarantee here is about work Daedalus5 controls. None of them promises a quantity of anything — not conversations, customers, bookings, revenue, a conversion rate or a return — because those depend on the contact list you supply and on what your team does with what we hand it.
1. What you are buying
Both products work the demand your business has already created. Neither generates demand, and neither supplies you with contacts.
1a. D5 Growth
D5 Growth is a sales system that we configure, install around your existing sales process and then manage. It handles repeatable work between an inquiry arriving and a sale closing — which may include first response, follow-up sequences, email and text communication, qualification steps, scheduling, reminders, no-show and cancellation recovery, estimate follow-up, stale-opportunity recovery, nurture, handoff notifications, pipeline management and reporting — and routes defined moments to a person on your team instead of automating them.
- D5 Growth is not an AI salesperson, a CRM subscription, generic automation or a replacement for your sales team. Nothing we build negotiates or closes.
- Which of those routes your system includes is set by your written quote, together with the integrations, users, locations, data migration and communication volume it covers. Nothing in a D5 Growth engagement is unlimited.
- You keep your own accounts, phone numbers, sending domain, data and customer relationships. Where the system uses a third-party platform, the applicable subscription, messaging, carrier and registration fees are yours unless your quote says otherwise in writing.
- The monthly fee is for management: monitoring, maintenance, adjustment as your business changes, and reporting. It is not a software licence and it does not buy an unlimited number of changes.
1b. D5 Echo
D5 Echo is a managed follow-up and reactivation service. You supply eligible contacts your own business already created — inquiries, estimates, canceled appointments, no-shows and former customers. We organize them by what happened, write and run an approved series of emails, eligible text messages and, where included and permitted, selected calls, classify the replies, and return qualified conversations to your team with context.
- D5 Echo is not software, a CRM, a lead-generation service, a lead broker or an outsourced sales team. There is nothing to log into.
- Echo is selective. We are not obliged to contact every record you send, and we will recommend against working audiences we do not believe are viable.
1c. Both
- D5 does not close your sales. Consultations, quotes, scheduling, negotiation, closing, payment and service delivery remain yours under either product.
- A qualified conversation means a relevant response showing genuine current or near-term interest in discussing the service, price, availability, quote, enrollment, appointment or next step. Opens, clicks without communication, negative replies, wrong numbers, generic acknowledgments and opt-out requests are not qualified conversations.
- Taking both products is quoted as one engagement, and the sections below apply to each part of it according to which product that part is.
2. Pricing and how work is quoted
Nothing on the website is a package price. Every published figure is the lowest at which that engagement is offered. The figure that applies to you is the one in your written quote.
2a. D5 Growth
- D5 Growth starts at $1,500 for setup and $899 per month for ongoing management. Both are starting figures, not a package. The setup fee covers mapping, configuration, testing and launch; the monthly fee covers monitoring, maintenance, adjustment and reporting.
- What sets the figure: workflow complexity, the integrations required, the number of locations and users, data migration, communication volume, and how much ongoing management the system needs.
- Data migration is quoted separately where it is a real project. Moving or restructuring an existing database is not folded into a setup fee.
- Launch timing is a typical case, not a commitment. Where we say a standard implementation is normally ready in about three business days, that period begins when we have received the access, information and data we have asked you for, and it does not apply to builds involving heavy integration work, multiple locations or data migration.
2b. D5 Echo
- Echo Pilot — $499, charged once and available once per business: up to 500 selected eligible contacts, one audience group, one campaign angle, 7–10 days of follow-up and a pilot activity report. The $499 fee is credited toward a full Echo campaign, or toward the first invoice of an ongoing Echo program, started within 30 days of the Pilot report. The Pilot is a paid test. It is not free, not refundable on the basis of results, and carries no performance promise.
- Every campaign is quoted. There are no fixed packages. We review and clean the list first, then quote the campaign against what is genuinely usable. The quote is given to you in writing before any work begins, and the agreed figure does not change during the campaign it was quoted for.
- What sets the figure: the value of a customer to your business, the number of usable contacts remaining after cleaning, the number of audience groups the list divides into, the channels you confirm you are authorized to use, and whether the engagement is a one-time campaign or an ongoing program. A smaller list of high-value opportunities is routinely quoted above a larger list of low-value ones.
- One-time campaigns are charged once and start at $1,000. Ongoing follow-up is charged monthly and starts at $1,000 per month. Ongoing programs begin with a three-month operating period and then continue month to month.
- The starting figure is not a price list. The amount published on the D5 Echo page is the lowest at which an engagement is offered. Daedalus5 does not publish a price list, and every engagement is quoted individually.
2c. Both
- Nothing is charged before the scope and price are confirmed with you. There is no checkout on the website, requesting a quote creates no obligation, and a secure invoice is provided once the scope and price are agreed.
- The agreed figure does not change during the work it was quoted for. Work outside that scope is quoted separately before it is done, not added to an invoice.
3. What an engagement includes
Your written quote defines the scope of your engagement and forms part of these terms. For D5 Growth that means the workflows, integrations, users, locations, data migration, communication volume and reporting it covers. For D5 Echo it means contact volumes, audience groups, follow-up plans, touch counts, call attempts, channels and reporting. Where the quote and this page differ on the scope of your engagement, the quote governs.
A D5 Growth engagement includes mapping your current sales process, configuring the system, testing every route and handoff in the quote before launch, taking it live, and then monitoring, maintaining and adjusting it for as long as the monthly fee is paid. It does not include unlimited workflows, unlimited integrations, unlimited customization, unlimited data migration, or building or operating any part of your business other than what is quoted.
At every price, an engagement includes list review and cleaning, duplicate and opt-out removal, organizing contacts by what happened, the campaign angle and offer, all campaign copy, approved outreach, reply monitoring and classification, qualified-conversation handoff, and reporting. The service does not get smaller at a smaller price; only the volume does. An overview of what a campaign covers is on the D5 Echo page.
Neither product includes unlimited consulting, unlimited revisions, work beyond the volumes in your quote, or anything your team is responsible for under section 4.
4. Your contacts, permission and your responsibilities
This is the part that matters most, because it is about other people. It applies to both products: a D5 Growth system contacts your prospects and customers on your behalf just as a D5 Echo campaign does, and the same permission rules govern both.
Under D5 Growth you are additionally responsible for having somebody available to take a handoff. A system that reaches a person and finds nobody there produces a worse outcome for that prospect than no system at all, and we cannot fix that from our side.
- You confirm that you have the right to contact the people on the list you send us, and that you obtained their details lawfully in the course of your own business.
- You confirm which contacts may be contacted through which channel. Email, text message and telephone are separate permissions. A phone number in a database does not by itself mean every type of outreach is appropriate, and we act on your confirmation.
- SMS and calling are used only where you have confirmed that the relevant contacts may be contacted that way and the channel is included in your quote.
- The list must be your own company-owned contacts. Do not send purchased, scraped, rented or third-party lists, and do not include anyone who has already asked you to stop contacting them.
- Before launch, D5 and you confirm the sending setup, the reply destination, the approved channels and the contact permissions. Nothing is sent until you have approved the messages and the operating setup.
- You remain responsible for complying with the laws and platform rules that apply to contacting your own customers, including applicable marketing, messaging and privacy law. We act on your instructions in running the campaign, and nothing here is legal advice.
- Opt-out requests generated by the campaign are honored and removed from every subsequent send, and we pass them to you so your own records stay accurate.
- We may decline or stop a campaign where a list or a permission appears not to meet these requirements.

5. Fit review before work begins
An engagement has to have something to work with. Before anything is agreed, we review what you have — your inquiry volume and sales process for D5 Growth, your contact list for D5 Echo — and confirm whether it fits the work you want done. If it does not, we will tell you, and we will not take your money.
6. Term, cancellation and refunds
- D5 Growth setup. Before we begin building, you can cancel and receive a full refund of the setup fee. Once configuration has begun the fee covers work already performed and is not refundable on request — but it remains refundable under the guarantee in section 7a if we cannot get the system live.
- D5 Growth monthly management continues month to month and either of us can end it with 30 days’ written notice. The month in progress is payable and nothing further is charged. If you end the monthly management, the system stops being monitored, maintained and adjusted by us — we will tell you before you end it what continues to run on your own accounts and what does not.
- One-time campaigns and the Pilot. Before the plan and messaging are approved, you can cancel and receive a full refund. Once outreach has begun, the fee covers work already performed and is not refundable. There is nothing recurring to cancel.
- Ongoing follow-up begins with a three-month operating period so the process can be launched, real responses observed and the follow-up improved. That first three months is committed once the program starts.
- After the first three months, ongoing service continues month to month and either of us can end it with 30 days’ written notice. Work already performed and the month in progress are payable; nothing further is charged.
- Monthly volumes do not roll over from one month to the next.
7. The guarantee, and what sits outside it
7a. D5 Growth — live or refunded
If we cannot get your system built and live, the setup fee is refunded in full. That covers a build we are unable to complete, a technical failure on our side, or any other reason the system does not go live that is ours to own.
- It runs from the date we confirm we have received the access, information and data we asked you for. It does not apply where that material is not supplied or is incomplete, or where a third-party platform you have asked us to build on refuses, withdraws or restricts access.
- "Live" means the system we quoted is running and performing the routes set out in your quote. It does not mean the system has produced any particular commercial result, and section 7c applies.
7b. D5 Growth — 60 days of included changes
For the first 60 days after your system goes live, we edit, adjust and re-tune what we built at no additional charge. This covers changes to sequences, messages, timing, routing, handoff rules and reporting within the scope of what was quoted. It exists because most requests after launch are preferences rather than faults, and they should not turn into a dispute.
It does not cover new workflows, new integrations, new locations or users, additional data migration, or anything else that would have been quoted separately at the outset. Those are quoted separately when you ask for them.
7c. D5 Echo — no qualified activity, no fee
If a D5 Echo campaign produces no qualified activity at all within 60 days of launch, the campaign fee is refunded — and you keep the segmentation, the campaign copy and the report.
- "Qualified activity" means at least one qualified conversation across the campaign, as that term is defined in section 1c. The threshold is deliberately any rather than a number: how many responses a campaign produces depends on the list you supply, and that is not ours to promise.
- The 60 days run from launch — the date the first approved outreach is sent — not from the date of the quote or the invoice.
- It applies to a full one-time campaign and to the first month of an ongoing program. The $499 Echo Pilot is a paid test and is not covered.
- It is conditional on the things only you can do: supplying the contacts as agreed, approving the campaign so it can launch, confirming the channels, and not pausing or withdrawing the campaign during the 60 days. Where a campaign is stopped at your request, the guarantee ends with it.
7d. What sits outside every guarantee above
These are the limits that make the guarantees above possible. They are stated plainly because a guarantee without them is not one we could honour.
- The contact list you supply is yours, and its quality is yours. We segment, clean, plan, write and run against the records we are given. Where those records turn out to be older, smaller, colder or less accurate than you believed, the work has still been performed and the fee stands, provided the campaign produced qualified activity. Our protection against this is that we review a list first and tell you when it is not worth working — before you are invoiced, not after the campaign has run.
- Activity is not sales. Where contacts respond and your team does not convert them, the campaign has performed and no refund arises. What happens after a qualified handoff reaches you is yours: the consultation, the quote, the follow-through and the close.
- No quantity is promised. Neither product promises a number of conversations, replies, appointments, bookings or customers, nor revenue, a conversion rate or a return on investment. The guarantees cover our work, not your results.
- What happens after a conversation reaches your team is yours. Results depend on the quality and age of your data, contact permissions, prior customer experience, the offer, timing, market conditions, your inquiry volume, and what your team does with what it is handed.
- Neither generates new leads. Both work only the demand your business already created and the contacts you already have.
- Neither handles the conversations the follow-up starts beyond the defined handoff. Your team sells the work.
- D5 Growth does not guarantee any launch date. Timings on the website are typical cases, conditional on receiving what we asked for, and are not commitments.
- Neither cleans, restructures or maintains your CRM beyond the work quoted.
- Illustrative material on the website — including the sample Echo report, the dormant-list calculator and every diagram — is illustrative only. It is not a forecast, a case study or a promise of any result.
8. Availability
Both products depend on networks, platforms and suppliers operated by other companies — email and messaging providers, carriers, scheduling and CRM platforms, and the registration bodies that approve business messaging in the United States. We work to keep your system and your campaigns running and will fix what is ours to fix, but we cannot promise uninterrupted service, acceptance or delivery by any particular platform, carrier or provider, or delivery within any particular time. Where a third-party platform your system depends on changes its terms, its pricing or its behavior, we will tell you and propose the alternative, but we do not control it.
9. Liability
To the extent permitted by law, Daedalus5’s total liability arising out of the service is limited to the amount you have paid us in the twelve months before the claim. We are not liable for lost profits, lost bookings or other indirect losses.
10. Changes to these terms
If these terms change, the date at the top changes with them. Material changes affecting current customers will be sent to you directly, and the price of a campaign or program you have already approved will not change without notice to you first.
11. Governing law
These terms are governed by the laws of the State of Ohio, United States.
